ANATOMICAL GIFT

In April, 2007 the Kansas legislature enacted the Revised Uniform Anatomical Gift Act. Those who can authorize an anatomical gift are as follows:

An Agent of the decedent at the time of death who could have made an anatomical gift immediately before the death. In the absence of such authority, Kansas statute gives an order of priority for those who can give permission:

1st     Spouse                                                  2nd          adult son or daughter

3rd    Either parent                                        4th           adult brother or sister

5th     adult grandchildren                           6th            grandparents 

7th     a Guardian of the decedent at the time of death

8th     an adult who exhibited special care and concern for the decedent

          and was familiar with his wishes

9th     anyone authorized to dispose of the body
