MISSOURI PUZZLE

Winston died intestate leaving a Net Probate Estate of $100,000.  He had no blood relative, but some relatives of Miranda (his deceased spouse) survive him.  His wife’s Aunt Susie (on her mother’s side) and Susie’s children Ramona and Abigail are still alive; as is her second cousin Elvis, on her father’s side.  How much does each relative receive?

SOLUTION TO PUZZLE USING MISSOURI LAW

Winston left no blood relatives, so all of his Estate goes to Miranda’s relatives.  The Estate is distributed as if Miranda inherited the $100,000 and then died without a Will.  Miranda is not survived by a parent, or sibling, or a niece or nephew, so all the estate goes to her grandparents, aunts and uncles (or their descendants) in equal parts, per stirpes.  None of Miranda’s grandparents are alive, but she does have Aunt Susie, and a decedent of a deceased aunt or uncle (namely Elvis).

The Estate is divided between Miranda’s aunts and uncles.  There is one surviving aunt (Susie) and one deceased aunt or uncle.  Elvis is a second cousin, so he is a descendant of that deceased aunt or uncle. Susie and Elvis share equally in the estate.  Aunt Susie’s children (Ramona and Abigail) inherit nothing because their mother is still alive.

ANSWER: Aunt Susie gets $50,000 and Elvis gets $50,000.
